For ease of reference here is a quick guide to the main aspects of our Transport Liability Wording, (for Transport, Cargo Handling and Associated Services):
Cargo and Related Liabilities: If you provide your customers with transport and handling services and do not own or charter the vessel or aircraft moving the cargo you are covered for claims in respect of:
- Physical loss of or damage to cargo in your care, custody and control.
- Consequential loss arising from the above
- Unrecoverable cargo’s contribution to general average.
Third Party Legal Liability: In the course of providing your services you could cause an accident which may in turn expose you to a claim from someone with whom you have no contractual relationship. Cover for such claims is provided under this section in addition to any third party indemnities which may need to be given to others in the normal course of business.
Claims Expenses: This section covers the costs involved in investigating and defending claims, as well as those extra costs you may incur due to a consignee’s failure to collect its cargo.
Liability to an Authority Extension: You may face claims from an Authority arising from an unintentional breach of a regulation, legal or statutory provision.
Professional Indemnity Extension: At its most simple, this covers claims arising from an error or omission in the exercise of your professional services. Under most jurisdictions this liability extends not only to your customer’s losses, but also those of other parties who you could reasonably have known would be replying on your knowledge or skill. Our cover under this section also extends to liability arising out of fraud of employees, libel slander or infringement of personal rights, misdirected claims and the unintentional breach of a regulation/warranty of authority/legal or statutory provision.
An attractive feature within our policy wording is that we credit our client’s who remain claims free and renew their cover with us with a 10% premium rebate to reward this loyalty and excellent claims performance.
